In a significant ruling, the Supreme Court of India granted bail to Delhi Chief Minister Arvind Kejriwal in a case related to alleged irregularities in the Delhi excise policy. The court criticized the Central Bureau of Investigation (CBI) for its timing, suggesting that Kejriwal’s arrest seemed to be an attempt to obstruct the bail granted to him in a related Enforcement Directorate (ED) case.
Justice Ujjal Bhuyan, in his observations, noted that the CBI did not deem it necessary to arrest Kejriwal earlier, despite interrogating him in March 2023. The arrest came only after he was granted bail in the ED case, raising questions about the timing. The court emphasized that the CBI must act impartially and not appear to function like a “caged parrot,” a term that implies being influenced by external forces.
The ruling highlighted the importance of upholding legal fairness and cautioned against using arrest as a tool for harassment. Kejriwal was directed not to make public statements regarding the case while on bail

न्यायमूर्ति उज्जल भुइयां ने अपने फैसले में कहा कि CBI ने मार्च 2023 में केजरीवाल से पूछताछ के बावजूद उन्हें तब गिरफ्तार नहीं किया, और उनकी गिरफ्तारी तभी हुई जब ED मामले में उन्हें जमानत मिल चुकी थी। इस घटना के समय पर अदालत ने आपत्ति जताई और कहा कि CBI को निष्पक्षता से काम करना चाहिए और किसी बाहरी दबाव के अधीन नहीं दिखना चाहिए, जैसा कि ‘पिंजरे का तोता’ शब्द से संकेत मिलता है।
अदालत ने कानून की निष्पक्षता को बनाए रखने के महत्व पर जोर दिया और गिरफ्तारी को उत्पीड़न के साधन के रूप में इस्तेमाल न करने की चेतावनी दी। केजरीवाल को जमानत के दौरान मामले पर सार्वजनिक बयान देने से रोका गया है।
